An Alexander, Ark., man faces felony and misdemeanor charges after allegedly exposing himself to a server at a Thayer restaurant.

Gabriel L. Gordey, 26, is charged with felony first-degree harassment and misdemeanor first-degree sexual misconduct following an Oct. 14 incident at the State Line Restaurant in Thayer.

Court records show Gordey was held on a $10,000 bond and is scheduled to appear Wednesday morning before Associate 37th Circuit Judge Harvey Shane Allen for a counsel status and bond review hearing.

Gordey pleaded not guilty and, during an initial appearance on Thursday, stated his intent to apply for a public defender. Court records show that, on Tuesday, Springfield attorney Lacon Marie Smith filed an entry of appearance to represent him in the case.

According to a probable cause statement filed by Oregon County Sheriff’s Deputy J.D. Eudaley, the server reported she was clearing dishes from a table when she observed Gordon expose his genitals through an open zipper, causing her severe emotional distress and a panic attack.

A co-worker called by the server to confirm the report also observed Gordey exposed and told him, “That is messed up,” according to court documents.

Eudaley reviewed restaurant security footage, which showed Gordey sitting alone after three other men left the table. Video reportedly showed Gordon manipulating the front of his jeans while repeatedly looking around the dining room.

When the second employee approached the table, Gordey panicked, abruptly stood up, nearly knocked over a chair, adjusted his pants and quickly left the restaurant.

Deputies later identified the vehicle from the security footage and conducted a traffic stop as he traveled north on U.S. 63. Eudaley made contact with Gordey, who was a passenger in the vehicle.

Investigators confirmed Gordey’s identity through company credit card records provided by his employer, who had paid for the table’s meal.

During questioning at the Oregon County Sheriff’s Office, Gordey was advised of his Miranda rights and denied exposing himself, according to the statement.
