Heading into the Fourth of July holiday, the West Plains City Council approved multiple seasonal fireworks permits and advanced major overhauls to municipal property maintenance and animal shelter regulations during its regular session meeting Monday.
As part of the council's consent agenda, members approved two permits for upcoming holiday fireworks displays scheduled for July 4. The permits authorize a private display by Kenny Phegley on property off Lanton Road and the annual display at the West Plains Country Club.
These actions follow two permits issued during the council's May session. Those previously approved events include the Give Local First "SkyFire" display scheduled for July 3 at the Heart of the Ozarks Fairgrounds, and a display by Freedom Patch Fireworks and the Sons of the American Revolution on July 8 at West Plains High School.
Highlights of regular meeting business were a vote to dissolve the Galloway Creek Advisory Board and the first reading, votes and discussions of ordinances pertaining to animal control and rules about the upkeep of personal property under nuisance and zoning ordinances.
City Administrator Sam Anselm explained the advisory board was created in 2003 to support the park’s development, but had not met in about a year. Since then, Anselm said, the city has taken a comprehensive role in planning, maintaining and improving the park. Anselm noted that remaining board members gave their official blessing to dissolve the entity.
Council members heard the first reading of Bill 4824, which proposes significant changes to municipal animal control guidelines to address severe pound overcrowding.
Although Animal Control Officer Brad Jones was not at the meeting, he noted in a written request that the proposed changes would eliminate the voluntary relinquishment of dogs to the pound by their owners. Under current rules, owners can surrender animals for a flat fee, but Jones stated that the fee does not cover the long-term cost of care and significantly limits open kennel space needed for stray animals.
To help move animals out of the facility faster, the updated ordinance allows owners to reclaim impounded dogs without proof of an active rabies vaccination, provided they sign an agreement to vaccinate the animal within a prescribed period. If a dog is subsequently found running at large without the required vaccination, the owner will face direct municipal prosecution.
During the presentation of first readings for Bills 4825 and 4826, Code Enforcement Officer Tracy Morris explained the proposed property maintenance revisions are meant to clarify rules and consequences for violations. The rules are in place not only to make properties located in the city more pleasing to look at, but for public health and safety, Morris commented.
Sho noted piles of debris such as furniture, appliances and scrap materials in yards create immediate public health threats by encouraging populations of rodents and other vermin to nest. Safety concerns also extend to high grass and overgrown brush, which Morris said can create blind spots for drivers at intersections, pose fire hazards, exacerbate seasonal allergies and provide a hiding spot for human trespassers.
The proposed zoning updates establish explicit street setbacks for residential fences to maintain clear lines of sight for drivers, particularly on corner lots. Property owners will also be required to keep fences clear of overgrown foliage that blocks traffic visibility. Additionally, the code will explicitly forbid the use of whole shipping pallets as fencing material, though lumber from disassembled pallets may still be used to construct conventional fences.
The council received no public comment regarding the proposed code changes.
A second reading and final vote on the animal control, nuisance and zoning ordinances will be held during the next regular session meeting.
